16-15 FIGHTING AND DISORDERLY CONDUCT.

No person shall revel, quarrel, fight, brawl or otherwise engage in any disorderly conduct so as to disturb the public peace and quiet. Any person violating the provisions of this section shall be liable to the penalty stated in Chapter I, Section 1-5. (1966 Code § 3-15; Ord. No. 1991-1 § 16).

Belmar Simple Assault Charge

An individual may be charged with a New Jersey criminal code violation for Simple Assault under N.J.S.A. 2C:12-1.  A conviction for violating this statute will result in a criminal record.  Our lawyers are typically able to have assault charges dismissed and/or downgraded.  The statute provides as follows:

a. Simple.  A person is guilty of assault if he:

(1) Attempts to cause or purposely, knowingly, or recklessly causes bodily injury to another; or

(2) Negligently causes bodily injury to another with a deadly weapon; or

(3) Attempts by physical menace to put another in fear of imminent serious bodily injury.

Simple Assault is a disorderly persons offense unless cimmitted in a fight or scuffle entered into by mutual consent, in which case it is a petty disorderly persons offense.
