Many individuals do not realize that the same standards governing drinking and driving of road vehicles, also apply to operation of a boat.  An individual is therefore subject to arrest for DWI, DUI & Refusal where he or she is the operator of a boat while possessing a blood alcohol concentration in excess of 0.08% and/or being under the influence of drugs.

The statutes governing drunk driving of a boat are almost identical to those for operation of a motor vehicle.  The penalties are also virtually identical.  Similarly, the implied consent which imposes an obligation to provide a breath sample also obligates an operator of a boat to submit to a breath test.  The converse is also true, however; many of the same defenses which allow us to succeed in a motor vehicle setting also apply with respect to boating drunk driving.
