Ignition Interlock Device

New Jersey DWI Law provides for installation of an ignition interlock device on automobiles owned and/or operated by certain individuals who have been convicted of DWI, DUI and/or Refusal. An ignition interlock is a device which disables the ignition of an automobile unless and until the operator of the vehicle blows a clean breath test sample into the device.

The requirements for installation of an ignition interlock device are set forth at N.J.S.A. 39:4-50.16 of New Jersey’s drinking and driving statute. The effective date of the ignition interlock provision is September 30, 2000 and any DWI, DUI or Refusal to submit to Breath Test occurring after this date is subject to this provision. The installation of an ignition interlock arises in conjunction with those convicted of a second DWI, or 3rd DWI offense & subsequent drunk driving charge. The statute provides for authority to require installation of the device as a condition of restoration of an individual’s motor vehicle privileges. The period of installation can range from one to three years, depending on the facts and circumstances surrounding the driving while intoxicated or driving under the influence offense.
