Former DWI Prosecutor With Office in Woodbridge
The municipal court in Woodbridge NJ may be the busiest in the state for handling DWI charges. There are many reasons for this circumstance, including the fact that major roadways like the New Jersey Turnpike, Garden State Parkway, U.S. Highway 1, and Route 18, run directly through Woodbridge. Another major factor that contributes to the rate of DWI arrests is the presence of one of the largest New Jersey State Police barracks. If you are facing a driving while intoxicated offense, the highly skilled New Jersey DWI lawyers at our firm, the Law Offices of Marshall, Bonus, Proetta & Oliver can offer you superior representation. We are the only firm in the state with this level of qualification: three (3) lawyers who are certified on the Alcotest Breath Test Machine (there are perhaps 50 total statewide); three (3) attorneys who are instructors in Standardized Field Sobriety Testing (approximately 5 have this credential in the entire state), which is the only way to prove a DWI once the breath test readings are eliminated; former municipal prosecutors in several municipalities; over 100 years of collective experience defending DWI, DUI and refusal cases; and one of the only firms in the entire state with a New Jersey version of the Draeger Alcotest 7110 for us to experiment with. It also helps that we happen to have a Woodbridge office. We take defending driving while intoxicated charges very seriously as illustrated by our training and experience, and we produce results. Give us a call anytime 24/7 if you or a loved one needs our help.

DWI Law & Penalties in New Jersey
The driving while intoxicated law is set forth at N.J.S.A. 39:4-50. The statute prohibits anyone from operating a motor vehicle while possessing a blood alcohol concentration (BAC) of .08% or more, or operating under the influence of drugs, including marijuana and prescription drugs. The prosecutor must establish both operation and intoxication to prove a DWI under N.J.S.A. 39:4-50. The element of operation is establish if, and only if, there is actual operation or an intent to operate (e.g. keys in ignition with intention to move vehicle). Proof of Intoxication is classically established through a breath sample but can also be proven via blood or urine. Where scientific evidence of this nature is lacking, a DWI or DUI may generally be proven through Field Sobriety Testing for alcohol intoxication and Drug Recognition Testing for driving under the influence of drugs. The license suspension for a First Offense ranges from three (3) months for a case with no BAC readings or readings between .08% and .099%, and seven (7) months to one year for BAC readings of .10% or more. The suspension is a mandatory two (2) years for a Second Offense and ten (10) years for a Third Offense or more. Fines and assessments approximate $800 to $1,500 depending on whether it is a First, Second or Third Offense. A mandatory state surcharge of at least one thousand dollars ($1,000) for 3 years also applies. Jail exposure is up to thirty (30) days for a First Offense, two (2) days to ninety (90) days for a Second Offense and one hundred eighty days (180) for a Third or subsequent offense. We encourage you to consult our practice pages on these issues for more detail on the law or related penalties. You may also contact our office for a free consultation with one of our lawyers.
