Manasquan Drinking in Public Ordinance

The Borough of Manasquan has adopted an ordinance concerning places where alcoholic beverages may be consumed including open containers. The Borough strictly enforces the drinking in public and open container ordinance of Manasquan. The ordinance provides as follows:
3-2.1 Consumption in Certain Places Restricted.
It shall be unlawful for any person, including but not limited to an occupant of a motor vehicle, to consume or pretend to consume any alcoholic beverage or to possess any open or unsealed container containing an alcoholic beverage in or upon any public sidewalk, public highway, public park, public recreation area, public parking lot, public boardwalk, public beach, public conveyance or any quasi-public place unless a permit for that purpose shall have been issued by the Director of Alcoholic Beverage Control with the consent of the Governing Body. Quasi-public place shall mean any sidewalk, parking lot, driveway, alley, walkway or other open area adjacent to any nonresidential building or non-residential use. (1972 Code § 38-33; Ord.
