License Suspension/Revocation
A conviction for driving while intoxicated (DUI) has serious consequences, including the loss of driving privileges. You rely on driving to fulfill school, work, and family obligations, and suspension of your license may make it very difficult to fulfill those commitments. The first important question thats needs to be answered when you are charged with drinking and driving in New Jersey is whether this is your first offense, second offense, or third or subsequent offense. Also, it is important to determine whether you have a refusal on your record and whether the charges you are facing currently are for DWI or Refusal. This can significantly effect the amount of time your New Jersey Driver's License is suspended. Generally, if your breathalyzer readings are between .08% and .10% and it is your first offense, you are looking at a 3 month license suspension. If your breathalyzer readings are greater than .10% and it is your first offense then you are looking at between 7 months and 1 year loss of license. If it is your second offense then you are looking at a two year license suspension and if it is your third offense you are looking at a 10 year license suspension. Therefore, the categorization of any prior offenses is crucial in determining your penalties for this driving while intoxicated charge. Recovering Driving Privileges after a DUI
Many clients assume that once they serve their suspension for DWI in New Jersey, their license is automatically reinstated. This is an incorrect assumption. In order for your license to be restored, you must go to a motor vehicle station and apply for reinstatement while paying a $100 reinstatement fee. This is very important to remember because otherwise you will still be driving with a suspended license and, if you are stopped, you could face serious penalties.
