Second-offense DWIs are some of the hardest fought cases in New Jersey. Because New Jersey prohibits plea bargaining, the prosecutor in your case cannot reduce your charge, leaving you no choice but to attack the case. In addition, you are facing more significant penalties than for a first DWI.
For a second DWI conviction, your penalties could include:
- A mandatory two-year driver’s license suspension
- Fines between $500 and $1,000, plus surcharges and other costs
- Thirty days of community service
- Between 48 hours and 90 days in jail
- A requirement to install an ignition interlock device on your vehicle
- Other consequences
